01Agreement to these terms #
These Terms of Service (“Terms”) are an agreement between you and [Slurpy legal entity name] (“Slurpy,” “we,” “us”). They cover your use of slurpy.co, creator pages at slurpy.co/username and connected custom domains, the creator dashboard at manage.slurpy.co, the agency product at agency.slurpy.co, and related services (the “Service”).
By creating an account, or by using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service. If you use Slurpy on behalf of a business or agency, you confirm that you are authorized to accept these Terms on its behalf, and “you” includes that business.
In these Terms, a “creator” is anyone with a Slurpy account who publishes a page. A “fan” or “buyer” is anyone who visits, buys from, books with, tips, messages or subscribes to a creator.
02Eligibility #
- You must be at least 18 years old, and an adult where you live, to create or hold a Slurpy account, sell, or buy.
- You must be at least 18, or the age of majority where you live if that is higher, to view adult content. You must also be legally allowed to view it where you are.
- You can’t use Slurpy if we have previously banned you, or if you are barred from receiving services under US sanctions or other applicable law.
- To sell or receive payouts, you must also meet Stripe’s eligibility and verification requirements.
03Your account #
- Give accurate information when you sign up, and keep it up to date, especially your email address. We use it for verification, receipts and important notices.
- You must verify your email address before some features become available.
- Keep your password secure and don’t share your account. You’re responsible for activity on your account. Tell us right away at info@slurpy.co if you suspect unauthorized access.
- One person may hold more than one account only if each account follows these Terms. Don’t create accounts in bulk or by automated means, or to get around a suspension.
- Agencies. If you use the agency product to manage pages for other people, you must have their permission. You’re responsible for following these Terms for every page you manage, and each person shown must meet the eligibility and consent rules in these Terms.
04Usernames #
Your username becomes your link: slurpy.co/username. Usernames are allocated first come, first served, and we license them to you; you don’t own them.
- Reserved names. Some names are reserved and can’t be registered, such as names used for Slurpy’s own pages and features (for example, privacy, terms, pricing) and names likely to confuse people.
- No impersonation. Don’t pick a username that impersonates another person, brand or organization, or misleads people about who you are or who you’re affiliated with.
- No squatting or selling. Don’t register usernames just to hold them, or sell, trade or transfer them.
- Reclaiming names. We may change, remove or reassign a username if it infringes trademark or other rights, impersonates someone, or violates these Terms. We may also reclaim a username that has been inactive for a long period, or that was reserved and never used. Before reclaiming an inactive username, we’ll make reasonable efforts to notify you at your account email.
05Plans, billing & cancellation #
Paid plans aren’t available yet. At launch Slurpy offers only the Free plan, and nobody can buy or be charged for a paid plan. The plans, prices and rules below describe how paid plans will work once they open. We’ll announce them (for example by email or in the dashboard) before anyone can subscribe, and features included in the Free plan won’t be removed from it when they do.
Planned prices, in US dollars:
- Free
- $0
- Pro
- $6 per month, or $60 per year
- Premium
- $15 per month, or $150 per year
- Super
- $29 per month, or $290 per year
- Billing. Paid plans are billed in advance at the start of each billing cycle, monthly or yearly, through Stripe. Applicable taxes may be added.
- Automatic renewal. Your plan renews automatically at the end of each cycle at the then-current price until you cancel. By subscribing, you authorize us (through Stripe) to charge your payment method each cycle.
- No free trial. Paid plans don’t include a free trial. The Free plan is available to try Slurpy at no cost.
- Upgrades take effect right away. You’re charged a prorated amount for the rest of the current cycle.
- Cancellation. You can cancel anytime from your dashboard. Your plan stays active until the end of the period you’ve paid for, and then it won’t renew.
- Downgrades. If you downgrade or your paid plan ends, we don’t delete your content. Features that aren’t part of your new plan are locked until you upgrade again.
- Price changes. We may change plan prices. We’ll give you advance notice, and a new price applies from your next billing cycle after the notice. If you don’t agree, you can cancel before then.
- Failed payments. If a payment fails, we may retry it. If it still can’t be collected, we may move your account to the Free plan.
06Selling: payments, fees & payouts #
Creators can sell digital products (such as PDFs, music and content packs), merch, bookings and appointments, and memberships. They can also accept tips and paid DMs.
- Stripe processes payments. To get paid, you must connect a Stripe account and accept Stripe’s own terms. Stripe may ask for identity, business, tax and bank information, and may hold, delay or refuse payouts under its policies. Slurpy doesn’t control Stripe’s verification or payout decisions.
- Our fee is 0%. Slurpy takes no commission on sales, bookings, tips or memberships. Stripe’s standard processing fees apply and are deducted by Stripe. The only exception is paid DMs (see below).
- Payouts are made by Stripe to your connected account, on Stripe’s schedule.
- You are the seller. The contract for a sale, booking or membership is between you and your buyer. Slurpy provides the tools and is not a party to it. You are responsible for describing what you sell accurately, delivering it as promised, setting your prices, honoring your own policies, and handling customer service.
- Taxes. You are responsible for any sales tax, VAT, income tax and other taxes on your sales and earnings, and for any tax registrations they require. Stripe may issue tax forms where the law requires it.
- Merch and physical goods. You are responsible for production, shipping, customs, returns and product safety.
- Memberships renew on the schedule you set and show to buyers. Buyers can cancel future renewals at any time.
- Chargebacks and disputes. You are responsible for chargebacks, disputes and refunds on your sales, including related Stripe fees.
- Restricted products. You may only sell items that are legal and allowed by these Terms and by Stripe’s policies. Don’t sell anything you don’t have the rights to.
07Paid DMs #
Creators can charge fans to send them a direct message. For each paid DM, the creator receives 80% of the price and Slurpy keeps 20% as a service fee. Stripe’s processing fees also apply.
- A fan pays to deliver the message. Unless the creator states otherwise, payment doesn’t guarantee a reply, a particular kind of reply, or a reply within a particular time.
- Creators must not use paid DMs to mislead fans about what they’ll receive.
- Everything in these Terms applies to messages: no harassment, threats, exploitation, or illegal content, and no soliciting offline sexual services. We may review reported messages to enforce these Terms.
08Refunds #
Purchases from creators
Refunds for products, merch, bookings, memberships, tips and paid DMs are between the buyer and the creator. Each creator sets their own refund policy, which must comply with consumer protection law. If you have a problem with a purchase, contact the creator first. If you can’t resolve it, email info@slurpy.co. We may help, but we’re not obligated to issue refunds for creators’ sales. Unauthorized charges should be reported to us and to your card issuer.
Slurpy plan fees
Plan fees are paid in advance and are generally non-refundable, including for partial billing periods. When you cancel, you keep access until the end of the period. If you believe you were charged in error, or the law where you live gives you a right to a refund, contact info@slurpy.co within 30 days of the charge and we’ll review it.
09Your content #
- You own it. You keep ownership of the photos, videos, text, products, music and other material you upload (“your content”).
- The license you give us. You grant Slurpy a worldwide, non-exclusive, royalty-free license to host, store, copy, process, adapt (for example, resize or transcode), display, perform and distribute your content. The license is only for operating, securing and improving the Service, including delivering your content to buyers and members. We may show your public page or username in promotional material for Slurpy, but we won’t show paid, members-only or adult content in promotions without your permission. The license ends when you delete the content or your account, except for copies that buyers have already purchased, content shared in messages, reasonable backup retention, and anything we must keep for legal reasons.
- Your responsibility. You confirm that you have all the rights, licenses and consents needed for your content, including consent from every person who appears in it, and that your content and its use on Slurpy don’t violate the law or anyone’s rights.
- Buyers’ license. When a fan buys digital content, they get a personal, non-commercial license to access and use it, unless the creator grants broader rights. Fans may not redistribute, resell or publicly post purchased or members-only content.
- Our content. Slurpy’s software, design, logos and templates belong to us or our licensors. You may use them only as part of the Service.
- Feedback. If you send us suggestions, we may use them freely and without any obligation to you.
We don’t pre-screen all content. We may review, remove, restrict or age-gate content, and may disable features, when we believe it breaks these Terms or the law, or creates risk for users or for Slurpy.
10Prohibited content & conduct #
You may not post, sell or link to content that:
- sexualizes minors in any way, or that is non-consensual (see Zero tolerance);
- infringes copyright, trademark, privacy or publicity rights, including reposting other people’s content without permission;
- shares someone’s private information or intimate images without their consent (“doxxing” or “revenge porn”);
- threatens, harasses, bullies or promotes violence against any person or group, or promotes terrorism or violent extremism;
- promotes self-harm, suicide or eating disorders;
- offers illegal goods or services, including drugs, weapons, counterfeit goods, stolen data, or prostitution or other sexual services offered in person;
- is fraudulent or deceptive, including scams, phishing, fake giveaways, pyramid schemes, and misleading health or financial claims;
- contains malware, or links to sites that distribute it;
- is adult content that isn’t marked and age-gated according to Adult content;
- violates Stripe’s restricted-business policies or any applicable law.
You may not:
- impersonate anyone or misrepresent your identity or affiliation;
- send spam or unsolicited bulk messages, or buy, scrape or harvest email lists;
- artificially inflate views, clicks, followers or sales;
- access the Service by automated means not provided by us, scrape it, probe it for vulnerabilities, or interfere with or overload it;
- get around access controls, paywalls, age gates, plan limits or a suspension;
- reverse engineer the Service, except where the law allows;
- use Slurpy to launder money, evade sanctions, or process payments for someone else’s business.
11Adult content (18+) #
Some plans let creators turn on an adult-content setting, which places their page or specific content behind an age gate. If you publish adult content:
- You must be at least 18 years old, and an adult where you live.
- You must turn on the adult-content setting and keep sexually explicit material behind the age gate. Never place it in public areas, profile photos, link previews or other areas that aren’t gated.
- Everyone depicted must be an adult who consented. Every person who appears in your content must have been at least 18 when it was created. Each must have consented to being recorded and to the content being published and sold on Slurpy.
- Records. You are responsible for obtaining and keeping proof of age and identity, and signed consent and release forms, for everyone who appears in your sexually explicit content. Where it applies, you are responsible for complying with the record-keeping requirements of 18 U.S.C. § 2257 and its regulations, and with similar laws elsewhere. On request, you must promptly provide us with proof of age and consent for anyone depicted. If you can’t, we may remove the content and suspend your account.
- You must follow the laws of the places where you create and sell content, including any age-verification laws that apply to you.
- Adult content still must follow every other part of these Terms. Content depicting incest, bestiality, non-consent, extreme violence or intoxication used to remove consent is not allowed, even when it is fictional or role-play.
Viewers: by passing an age gate, you confirm that you are at least 18, or the age of majority where you live if that is higher, and that viewing adult content is legal where you are. Don’t share age-gated content with anyone who isn’t.
12Zero tolerance: exploitation #
Slurpy has zero tolerance for:
- child sexual abuse material (CSAM), or any content that sexualizes minors, including drawn, animated, AI-generated or “age-play” content;
- non-consensual intimate content, including hidden-camera content, leaked content, and deepfakes or other sexual content made of real people without their consent;
- human trafficking, sexual exploitation, or coercion of any kind.
We will remove this content immediately, permanently ban the accounts involved, keep relevant records, and report apparent child sexual exploitation to the National Center for Missing & Exploited Children (NCMEC) as required by law. We also cooperate with law enforcement. If you see content like this, report it to info@slurpy.co right away. You can also report it directly to NCMEC at report.cybertip.org.
13Email marketing tools #
Creators can collect subscriber emails and send campaigns through Slurpy. If you do:
- only email people who opted in to hear from you, and never upload purchased, rented or scraped lists;
- follow anti-spam and privacy laws such as CAN-SPAM, CASL and GDPR where they apply, including identifying yourself accurately and using honest subject lines;
- keep the unsubscribe link in every campaign, and honor unsubscribe requests promptly;
- be clear when you collect emails about what subscribers will receive.
You control your subscriber list and decide how it’s used. Slurpy processes it on your behalf, as described in our Privacy Policy. We may limit or suspend sending if complaint or bounce rates are high, or if campaigns break these Terms.
14Bookings & calendars #
Creators can offer appointments and bookings, and may connect Google Calendar to sync availability and confirmed bookings. Creators are responsible for keeping availability accurate, showing up to bookings, and stating their own cancellation and rescheduling policies. If you connect Google Calendar, you authorize Slurpy to access your calendar to the extent needed for bookings. You can disconnect it at any time. Bookings must not be used to offer illegal services or in-person sexual services.
15Custom domains #
Some plans let you point a domain you own at your Slurpy page.
- You must own the domain or have the right to use it, and it must not infringe anyone’s trademark or other rights.
- You are responsible for registering and renewing the domain and for its DNS settings. Slurpy isn’t responsible for downtime caused by domain or DNS changes outside our control.
- Everything in these Terms applies to content served on your custom domain.
- If your plan no longer includes custom domains, or your domain stops pointing to Slurpy correctly, your custom domain may stop working, but your slurpy.co/username link continues to work. We may disconnect a domain that violates these Terms.
16Copyright & DMCA #
We respect intellectual property rights and respond to valid notices under the Digital Millennium Copyright Act (DMCA).
Submitting a takedown notice
If you believe content on Slurpy infringes your copyright, send our designated agent a written notice that includes:
- your physical or electronic signature;
- identification of the copyrighted work you claim is infringed;
- the specific location of the infringing material on Slurpy (for example, the page URL);
- your name, address, phone number and email address;
- a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent or the law;
- a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
- Designated agent
- Copyright Agent, [Slurpy legal entity name]
- info@slurpy.co (subject: “DMCA Notice”)
- [Mailing address]
Counter-notices
If your content was removed and you believe that was a mistake or misidentification, you can send a counter-notice to the same address. It must include: your signature; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; your name, address and phone number; and your consent to the jurisdiction of the federal court for your district (or, if you are outside the US, any district where Slurpy may be found) and to accept service from the person who sent the notice. We may restore the content after 10 to 14 business days, unless the complainant tells us they have filed a court action.
Repeat infringers
We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe. Misrepresenting infringement in a notice or counter-notice can make you liable for damages.
17Third-party services #
The Service connects to third-party services such as Stripe and Google, and creator pages link to other websites. Your use of third-party services is governed by their terms and privacy policies. We aren’t responsible for third-party services, websites or content, and links on creator pages don’t mean we endorse them.
18Suspension & termination #
- By you. You can stop using Slurpy and delete your account at any time. Cancel any paid plan first. Plan fees already paid aren’t refunded, except as described in Refunds.
- By us. We may suspend or terminate your account, remove content, or limit features if you breach these Terms, create risk or legal exposure for Slurpy or others, if Stripe or the law requires it, or if your account has been inactive for a long period. Where reasonable, we’ll tell you why and give you a chance to fix the problem. We won’t do this for zero-tolerance violations or where giving notice could cause harm or break the law.
- Effect. When your account ends, your page goes offline and your username may become available after a period. Unpaid amounts stay due. Payouts already in progress are handled by Stripe under its terms. If you have pending obligations to buyers, such as undelivered orders or upcoming bookings, you must still fulfil them or refund the buyers.
- Exporting. Before you close your account, download anything you want to keep. After termination, we’re not obligated to keep your content, except as described in our Privacy Policy.
- Sections that by their nature should survive termination will survive, including content licenses already granted to buyers, payment obligations, disclaimers, limitation of liability, indemnity and dispute resolution.
19Disclaimers #
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Slurpy disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We don’t warrant that the Service will be uninterrupted, error-free or secure, or that content will never be lost.
Creators, not Slurpy, are responsible for their content, products, bookings and conduct. We don’t guarantee any level of sales, traffic or earnings. Analytics, such as locations and visitor counts, are estimates. Slurpy is pre-launch, and some features may change, be limited, or be discontinued.
20Limitation of liability #
To the fullest extent permitted by law, Slurpy and its owners, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to the Service or these Terms, even if we were advised of the possibility.
Our total liability for any claim arising out of or relating to the Service or these Terms is limited to the greater of (a) the amounts you paid Slurpy in plan fees and paid-DM service fees in the 12 months before the event giving rise to the claim, or (b) $100.
Some jurisdictions don’t allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that can’t be limited by law, such as liability for fraud or, where applicable, gross negligence.
21Indemnity #
To the extent permitted by law, you agree to defend, indemnify and hold harmless Slurpy and its owners, employees and agents from claims, damages, losses and expenses, including reasonable legal fees, arising from: your content; your products, sales, bookings, memberships or messages; your use of the Service; your breach of these Terms; or your violation of any law or anyone’s rights. This includes claims about consent, age records, taxes or anti-spam rules.
22Governing law & disputes #
These Terms are governed by the laws of the State of [State] and applicable US federal law, without regard to conflict-of-law rules.
Talk to us first. Before filing any claim, please email info@slurpy.co and describe the issue. We’ll try in good faith to resolve it informally within 30 days.
If we can’t resolve it, disputes will be resolved by [Dispute-resolution method: e.g. binding individual arbitration, or the state and federal courts located in [County], [State]].
If you live in the EU or UK, nothing in these Terms takes away the protections of the mandatory consumer laws of your country, or your right to bring proceedings in your local courts.
23Changes to these terms #
We may update these Terms from time to time. We’ll change the “Last updated” date. If we make material changes, we’ll notify you in advance, for example by email or in the dashboard. Changes take effect on the date stated in the notice. If you keep using the Service after that date, you accept the updated Terms. If you don’t agree, stop using the Service and cancel your plan.
24General #
- Entire agreement. These Terms, the Privacy Policy and any policies they reference are the whole agreement between you and Slurpy about the Service.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
- No waiver. If we don’t enforce a right, we haven’t waived it.
- Assignment. You can’t transfer your account or these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets.
- Notices. We may send notices to your account email or show them in the dashboard. Send notices to us at info@slurpy.co.
- Force majeure. We aren’t liable for delays or failures caused by events beyond our reasonable control.
- Relationship. Creators are independent. Nothing in these Terms creates an employment, partnership, agency or joint-venture relationship with Slurpy.
